The Result of the Recent Case Battle

Dwight Whorley has officially fucked lolicons and normal anime fans over.

Two years ago, Dwight Whorley went to a local office of the Virginia Employment Commission (VEC) in Richmond, ostensibly to look for jobs online. Instead, he used the state's computer to download and send Japanese "anime" cartoons showing graphic acts of child pornography.

Because of a 2003 federal obscenity law, that's illegal . The law, designed to help protect children from sexual exploitation, makes it a federal crime to produce or distribute obscene drawings, cartoons, paintings, or any other visual representations involving the sexual abuse of children.

On December 1, Whorley—who had spent time in jail on previous federal child pornography charges—became the first person in the U.S. to be convicted under the 2003 law. On Friday (March 10), he was sentenced to 20 years in prison and fined $7,400.

Our cyber experts found digital photographs of child porn on the same VEC computer. Whorley had also used it to send explicit e-mails to a young girl and for other e-mails describing the sexual abuse of children—further violations of federal obscenity laws. In the end, we were able to link Whorley to the pornography, e-mails and other evidence on the computer. He was convicted of a total of 74 counts of obscenity and child pornography.

By examining the computer Whorley used, our agents were able to identify and track down other peddlers of child pornography, leading to a recent arrest by agents from our St. Joseph, Michigan, office near Detroit. Other cases are in motion.

Thanks a lot dude! Given the gullibility of the general public on Anime, you have reaffirmed that anything with a little girl in it is pornography, even to non-lolicons! I know a lot of hentai covers its tracks when it gets licensed in the states by saying that all the characters depicted are over a certain age, but the fact of the matter is that the chicas often don't look it.  Beyond hentai, I have to wonder that if they're going that crazy about it, just how many people and sites will get into trouble...

Hmm. Now that I think about it, posting this thread when I was far from rested probably blurred my judgement a bit. I could have sworn I read that the other guys were convicted on loli-pron alone.

And according to what I read on the site, the law was altered to include drawn versions. Let me see if I can find that particular page...

The 2003 Prosecutorial Remedies and Other Tools to End the Exploitation of Children Today act (PROTECT - Public Law 108-21), defines computer images that are indistinguishable from real children engaging in sexually explicit conduct as child pornography, while simple drawings which are easily distinguishable from real children are not considered child pornography.

It all comes down to interpretation of the law by the jury.  Whether loli-h is considered close enough to real child pornography or not isn't set in stone.  Although, this case is setting an upsetting precedence.

I know a while back that hongfire reportedly took down their loli galleries and had a lot of people worried or whatnots, but then ruled later, due to a previous case (can't remember which)they looked up. It basically stated that it's too ambiguous to designate anyone in anime or cartoons too young or whatever. I'd quote it here, but I'm not sure how to access their news archives that far back
